By accessing or using Spectral, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. We reserve the right to update these terms at any time, and continued use of the platform constitutes acceptance of any changes.

2. Service Description

Spectral is an online marketplace that connects customers seeking local services with qualified service providers (specialists). We facilitate the discovery, communication, and booking process between the two parties. Spectral does not perform the services itself and is not a party to any agreement between customers and providers.

3. User Accounts

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• Users may register as either a customer or a provider (specialist)
• You must be at least 18 years old to create an account
• You are responsible for all activity that occurs under your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Provider Obligations

As a service provider on Spectral, you agree to:

• Maintain accurate and up-to-date profile information
• Respond to customer inquiries in a timely manner
• Provide services as described in your profile and agreed upon with customers
• Comply with all applicable laws, regulations, and licensing requirements
• Maintain appropriate insurance where required by law
• Not misrepresent qualifications, experience, or pricing

5. Payments and Fees

• All payments are processed securely through Stripe
• Providers may be charged for leads based on their subscription plan
• Subscription plans (Free, Silver, Gold, Platinum) have varying lead allowances and pricing
• Lead costs are determined dynamically based on category, location, and demand
• Refunds for unused leads may be available at our discretion
• Providers are responsible for all applicable taxes on their earnings

6. Prohibited Conduct

You may not:

• Use the platform for any illegal or unauthorized purpose
• Harass, abuse, or threaten other users
• Submit false or misleading information
• Manipulate reviews, ratings, or search results
• Circumvent the platform to avoid fees (e.g., taking transactions off-platform)
• Scrape, crawl, or use automated means to access the platform without permission
• Impersonate another person or entity
• Upload malicious content or attempt to compromise platform security

7. Reviews and Content

• Reviews must reflect genuine experiences and be factually accurate
• We reserve the right to moderate and remove reviews that violate our guidelines
• By posting content on Spectral, you grant us a non-exclusive license to display it on the platform
• You retain ownership of content you create

8. Limitation of Liability

Spectral is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for the quality, safety, or legality of services provided by specialists
• We are not responsible for disputes between customers and providers
• Our total liability is limited to the amount you have paid to Spectral in the preceding 12 months
• We are not liable for indirect, incidental, or consequential damages

9. Intellectual Property

The Spectral name, logo, and all platform content (excluding user-generated content) are our intellectual property. You may not use, reproduce, or distribute our intellectual property without written permission.

10. Termination

You may terminate your account at any time by using the account deletion feature or contacting us. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the platform ceases immediately.

11. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through good-faith negotiation and, if necessary, through the competent courts.
